Terms of Service

These terms are an agreement between you and Axamattic Limited (“we”, “us”), a company registered in England and Wales (company number 15570389), at 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London, W1T 6EB. By using PicMyCals you agree to them.

1. Who can use PicMyCals

You must be 18 or over. You’re responsible for keeping your login secure and for activity on your account. Give us accurate information.

2. What PicMyCals does

PicMyCals estimates the calories and nutrients in your meals from photos and descriptions, and helps you track them against a daily target.

These estimates are made by artificial intelligence. Jools, the character who talks to you in the app, is an AI assistant, not a person.

3. Health disclaimer

Estimates, not advice: Nutrition figures are estimates made by AI and can be wrong. Treat them as a guide.
Not medical advice: PicMyCals is not a medical device. It doesn’t diagnose, treat or prevent any condition.
Talk to a professional: Check with a doctor or registered dietitian before changing your diet, especially if you are pregnant, have a health condition, or have a history of disordered eating.
Allergies: Never rely on PicMyCals to identify allergens or ingredients.

4. Subscriptions and free trials

Some features need a paid subscription, bought through the App Store or Google Play. Prices are shown in the app before you buy.
Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can cancel in your App Store or Google Play account settings. Deleting the app or your account does not cancel your subscription.
If you have a free trial, you will be charged when it ends unless you cancel before then.
Refunds are handled by Apple or Google under their policies. This doesn’t affect your statutory rights.
If you live in the UK or EU, you normally have a legal right to cancel a purchase of digital content within 14 days. Because a subscription starts as soon as you buy it, the store asks you to agree to immediate access, and that means you lose this 14-day right once the subscription starts. You can still cancel future renewals at any time, and ask Apple or Google for a refund under their policies.
We may change prices. Changes apply from your next renewal, and you’ll be told in advance as the store requires.

5. Fair use

To keep the service running well for everyone, there are reasonable daily limits on how many photos can be analysed. Normal use will never reach them.

6. Your content

You own your photos and data. You give us permission to store, process and analyse them only to provide the service to you. Don’t upload anything that’s illegal, that you don’t have the right to share, or that isn’t food-related.

7. Acceptable use

Don’t misuse the service. For example, don’t try to:

break or bypass its security or limits
reverse-engineer it
scrape it
resell access
use it to harm anyone.

8. Our intellectual property

The app, its design, branding and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app for its intended purpose.

If you downloaded PicMyCals from the App Store, your licence to use the app is Apple’s Standard Licensed Application End User License Agreement. These terms add to that licence but do not replace it.

9. Changes and availability

We’re always improving PicMyCals and may add, change or remove features. We aim to keep the service available but can’t guarantee it will always be uninterrupted or error-free.

10. Ending your account

You can delete your account at any time in Profile. We may suspend or close accounts that break these terms. Where reasonable, we’ll tell you first.

11. Liability

Nothing in these terms limits liability that can’t legally be limited. That includes death or personal injury caused by our negligence, fraud, and your statutory rights as a consumer.
Otherwise, PicMyCals is for personal use, and we aren’t liable for losses that weren’t foreseeable, or for decisions you make based on its nutrition estimates.

12. Changes to these terms

We may update these terms to reflect changes to PicMyCals, to the law, or to how we run the service. If a change is significant, we’ll give you reasonable notice in the app or by email before it takes effect.

If you don’t agree to a change, you can stop using PicMyCals and delete your account. If you have a subscription, you can cancel it before the change takes effect with no penalty. If you keep using PicMyCals after the change takes effect, the new terms apply.

13. Law

These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring a claim in your local courts.

If you live outside the UK, you keep the protection of any mandatory consumer laws of the country where you live, and you can bring a claim in your local courts.
